UK Service Terms and Conditions for Gardeners St Pancras

Gardening team preparing a client property for scheduled outdoor maintenanceThese Terms and Conditions set out the basis on which Gardeners St Pancras provides gardening and related outdoor maintenance services to residential and commercial clients across the UK. By making a booking, confirming a quotation, or allowing work to begin, the client agrees to be bound by these terms. They are designed to provide clarity on the service relationship, payment expectations, cancellations, liability, waste handling, and the rules that govern the agreement. For the avoidance of doubt, these terms apply to the provision of gardening services only and do not form a guide or advice document.

Throughout this document, references to “we,” “us,” and “our” mean the service provider operating as Gardeners St Pancras, while references to “you” and “the client” mean the person or organisation requesting the work. These terms may be updated from time to time, and the version in force at the time of booking will usually apply unless a different written agreement has been made. In all cases, any specific written quotation or agreed scope of work will take priority over any general wording where there is a conflict.

Professional gardener discussing a confirmed service booking and scope of workOur services may include lawn care, hedge trimming, planting, pruning, clearance, seasonal maintenance, and other common outdoor tasks agreed in advance. However, the exact nature of the work is limited to what has been quoted and accepted. Any additional tasks requested on the day may require a revised price, extra time, or a new booking. Clients are responsible for ensuring that the requested service is appropriate for the condition of the property and for disclosing any relevant limitations, hazards, or access issues before the work starts.

Booking Process

Bookings for gardening services by Gardeners St Pancras may be made by telephone, email, online form, or any other communication method we make available. A booking is not confirmed until we have acknowledged acceptance and, where applicable, received any required deposit or advance payment. Any estimate given before inspection is based on the information supplied by the client and may be adjusted if the site conditions differ from those described.

The client must provide accurate information when requesting a quotation or booking. This includes the size and condition of the garden, access arrangements, parking restrictions, utility hazards, wildlife issues, waste volume, and any special instructions. If the actual site conditions are materially different from the information supplied, we reserve the right to amend the price, reduce the scope of work, reschedule the service, or decline the job if it cannot reasonably be completed safely or lawfully.

Green waste and garden debris collected during routine maintenance workIt is the client’s responsibility to ensure access to the property at the scheduled time and to make sure that any gates, locks, pets, children, or obstacles do not prevent safe completion of the work. Where our team arrives and cannot begin because access is unavailable or the premises are not ready, a call-out fee or cancellation charge may apply. If the service depends on permissions from a landlord, managing agent, neighbour, or third party, the client must obtain those permissions before the booking date.

Payments and Pricing

Prices may be provided as fixed quotations, hourly rates, or estimated charges depending on the type of service. A quotation remains valid only for the period stated in it, or, if no period is stated, for a reasonable time based on market conditions and scheduling availability. We may revise a price before work begins if the client changes the requested scope or if the job is larger or more complex than first described. Any additional work must be agreed before it is carried out.

Unless otherwise agreed in writing, payment is due on completion of the service on the same day. For larger projects or recurring maintenance, we may request a deposit, part-payment, or staged payments in advance. We accept payment methods that we announce from time to time, and any bank transfer or card processing fees will be the client’s responsibility unless we state otherwise. Late or failed payment may result in suspension of further work, recovery action, or interest where permitted by law.

All stated prices are subject to any applicable taxes unless clearly indicated otherwise. If an invoice is issued, the client must check it promptly and raise any query within a reasonable period. The absence of a query does not reduce the client’s obligation to pay for services properly delivered. If a payment is reversed, charged back, or disputed without good reason, we may recover the full amount due together with reasonable administrative costs incurred in addressing the matter.

Cancellations, Rescheduling and Waiting Time

The client may cancel or reschedule a booking by giving reasonable notice. Unless a different arrangement is stated in the quotation, cancellations made with less than 24 hours’ notice may incur a cancellation charge reflecting the time reserved and any costs already incurred. Where materials have been ordered specifically for the job or where a crew has been allocated for a fixed date, further charges may be applied to cover non-recoverable losses.

If we need to cancel or reschedule due to adverse weather, staff illness, equipment failure, unsafe site conditions, or another event beyond our reasonable control, we will try to give notice as early as possible and arrange a new appointment. We are not responsible for indirect loss arising from a necessary rearrangement, although any prepayment for the affected service will usually be transferred or refunded as appropriate. In situations where access is delayed, waiting time may be charged if the delay prevents us from continuing to other scheduled work.

If the client is not present where attendance is required, or if no responsible adult is available to provide access or decisions, we may still proceed where safe and agreed, or we may leave the site and charge for the time lost. In some cases, repeated cancellations or repeated failure to provide access may lead us to refuse future bookings. Gardeners St Pancras aims to act fairly, but we reserve the right to protect our time, staff, and operational costs.

Scope of Work and Client Responsibilities

The service will be carried out with reasonable skill and care and in accordance with the agreed scope. The client must make sure the area to be worked on is reasonably clear of personal belongings, fragile items, underground hazards that have not been declared, and any dangerous materials. We are not responsible for moving or protecting items unless this has been specifically included in the quotation. If hidden obstacles, unsafe structures, contaminated materials, or nesting wildlife are discovered, we may pause the work and request instructions.

Any plants, trees, shrubs, fences, paving, irrigation systems, lighting, or decorative features that could be affected by the work should be identified by the client before the service begins. Gardening involves natural variation and sometimes unavoidable wear, especially where plants are mature, diseased, overgrown, or poorly rooted. We do not guarantee the survival of plants after pruning, transplanting, or treatment unless a separate written warranty has been expressly given. Our duty is to use reasonable care, not to achieve an absolute result beyond what horticultural conditions permit.

Liability and Limitations

We will not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation. Subject to that, our total liability for any claim arising from a service, whether in contract, tort, or otherwise, will be limited to the total amount paid or payable for the specific job giving rise to the claim, except where a higher limit is required by law. This limitation is intended to be fair and proportionate in the context of domestic and commercial gardening work.

We are not liable for damage caused by pre-existing defects, weak surfaces, hidden utilities, structural failure, abnormal weather, infestation, disease, or any issue that could not reasonably have been identified before the work began. Nor are we responsible for losses that are indirect or consequential, such as loss of profit, loss of enjoyment, or loss of opportunity, except where such limitation is prohibited by law. Clients are encouraged to maintain suitable insurance where the nature of the site or the value of the property makes this appropriate.

Gardening service terms relating to liability, safety, and waste handlingIf a client believes damage has occurred, the issue must be reported as soon as reasonably possible with sufficient detail to allow inspection. Where appropriate, we may seek to inspect the area before remedial work is carried out by a third party. Failure to give us that opportunity may affect the outcome of any claim. Nothing in these terms reduces the client’s statutory rights where services are supplied to consumers under applicable UK law.

Waste Regulations and Green Waste Handling

Green waste, soil, branches, grass cuttings, leaves, and other material removed during the job may be taken away if this has been included in the service or agreed separately. Any waste removed by us will be handled in line with applicable UK waste laws and local disposal requirements. We aim to dispose of green waste responsibly through authorised facilities or recycling routes wherever possible. The client must not ask us to dispose of hazardous, prohibited, or non-declared waste without prior written agreement.

Where waste remains on the client’s property for later collection or if the client prefers to manage disposal personally, the client is responsible for all lawful storage, transport, and disposal arrangements after our team has left. If waste is found to contain items that require specialist handling, such as asbestos, chemicals, medical waste, oils, sharps, or regulated materials, we may refuse to remove it and may charge for the time spent identifying the issue. Any contamination or improper classification of waste may result in additional costs.

We expect clients to provide accurate information about the type and quantity of waste likely to be produced. If the amount of waste is substantially greater than anticipated, or if it includes items outside the normal scope of garden waste, we may revise the quote or arrange a separate removal service where lawful and available. Gardeners St Pancras will not knowingly participate in illegal dumping, fly-tipping, or any disposal practice that breaches environmental regulations.

Health, Safety and Force Majeure

We operate on the basis of reasonable health and safety procedures, and the client must cooperate by making known any known risks before work begins. This includes unstable ground, broken steps, hidden wires, aggressive animals, contaminated areas, or restricted access points. If a task cannot be completed safely, we may stop work immediately and either propose a safer alternative or cancel the remaining portion of the booking. The client remains responsible for paying for work properly performed up to that point.

We are not liable for delay or failure to perform any obligation where the delay or failure is caused by an event beyond our reasonable control. This includes severe weather, flooding, fire, power failure, transport disruption, strike action, pandemic-related restrictions, government action, or supply chain interruption. Where such an event occurs, our obligations are suspended for the duration of the event, and we will resume performance when reasonably possible. If the event continues for an extended period, either party may be entitled to end the affected booking on fair notice.

Data, Complaints and General Legal Terms

Any personal information supplied in connection with a booking will be used only for legitimate business purposes such as scheduling, invoicing, customer administration, and record keeping, in line with applicable data protection law. We do not sell client data to third parties. Records relating to quotations, payments, and completed work may be retained for a reasonable period for accounting, legal, and service-management purposes.

If a client has a complaint, the matter should be raised promptly so that it can be reviewed fairly. We may request photographs, written details, or access to inspect the area concerned. However, nothing in these terms obliges us to provide a particular outcome unless required by law or expressly agreed in writing. Failure to enforce a right on one occasion does not waive that right for the future. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Final terms section for a UK gardening service agreementThese Terms and Conditions, together with the accepted quotation and any written amendments, form the entire agreement between the client and Gardeners St Pancras for the relevant service. No statement by any employee or contractor changes the agreement unless confirmed in writing by an authorised representative. By booking our services, the client confirms that they have read, understood, and accepted these terms in relation to the garden work requested.

Governing Law

The agreement between the client and the service provider is governed by the laws of England and Wales. Any dispute arising from or connected with these terms, the quotation, or the provision of services will be subject to the exclusive jurisdiction of the courts of England and Wales, unless the client benefits from mandatory consumer rights in another part of the UK that cannot lawfully be excluded. These terms are intended to be read in a sensible commercial manner and in accordance with applicable UK legislation.
